Judge blocks Pentagon blacklist of Anthropic as supply chain risk

A federal judge in California has ruled that the Pentagon's attempt to blacklist artificial intelligence company Anthropic earlier this year was a violation of the First Amendment, infringing upon the company's constitutionally protected rights.

U.S. District Judge Rita Lin overturned Anthropic's designation as a supply chain risk, stating that the Department of Defense's actions contravened the due process clause of the Fifth Amendment. The judge ordered the DOD to retract all related guidance, directives, communications, and instructions issued against the company.

The judge noted in her ruling that the defendants argued Anthropic's "increasingly hostile manner through the press" and its criticisms of the Department of War's stance on AI utilization meant they "cannot trust Anthropic to ensure the integrity of its models." However, she clarified that neither the Constitution nor the federal statute cited by the defendants permitted them to impose severe penalties primarily based on Anthropic's critique of the Administration's policies.

In March, the DOD had classified Anthropic as a supply chain risk, suggesting the company posed a threat to U.S. national security. This classification followed a breakdown in negotiations concerning the military's potential use of Anthropic's Claude AI models. The designation had prevented defense contractors from utilizing Anthropic's technology in their collaborations with the agency.

Anthropic had filed a lawsuit against the Trump administration to challenge its blacklisting. This California lawsuit is separate from a related case still active in Washington, D.C. The DOD's justification for the supply chain risk designation involved two distinct assessments, necessitating separate legal proceedings in different jurisdictions.

A spokesperson for Anthropic expressed satisfaction with the court's decision, stating, "We welcome the court's ruling that this supply chain risk designation was unlawful. We remain focused on working productively with the government to harness AI for our national security so all Americans benefit from this technology."

This ruling removes a significant obstacle for Anthropic as it prepares for an anticipated IPO. While the company has maintained its momentum despite the blacklisting, reinstating ties with the Pentagon could unlock new business opportunities that were previously unavailable.
